Judicial Reforms: Need to change

Procedural improvements–

It is evident that in some courts, the pendency rates are higher than in others. One court can learn from other courts where the rate of disposal of cases is higher and apply their procedures.

For example, Court no. 1 has a higher disposal rate of civil cases while Court no. 2 disposes of criminal matters faster than other courts. These two can share and adopt each others methodology.

The key point is: courts can learn from each other’s strengths and weaknesses. Justice V. R. Krishna Iyer once remarked that there was no reason why we should not have a performance commission for the judiciary.

Such a mechanism would help identify the courts which are lagging behind.
