Sedition vs. Freedom of Speech

Sec. 124-A of the IPC states, “Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards, the Government established by law in India, shall be punished with imprisonment for life, to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.”
Since the time the Constitution came into force, there are conflicting opinions as to whether or not the section violates Art.-19(1) of the Constitution. According to Art.-19(1)(a);
“All citizens shall have right to freedom of speech and expression”
As we know that the freedom of speech and expression is a fundamental right that is guaranteed to every citizen. As such, fundamental rights take precedence over any other provision of the constitution or any other act in force; so any law in violation of any fundamental right will be struck down.
