Former CJI Ranjan gogoi accepts the nomination to Rajya Sabha

The major doubts arise due to the fact, the foundation and power of the Indian Constitution lie in the separation of powers. The legislature is elected by the people, is responsible for forming the laws; the executive which is accountable to the legislature is responsible for the implementation of those laws, and the Judiciary is the saviour of the Constitution and, it provides a check against executive excesses, and unlawful steps.

To perform this task the judiciary has to be entirely independent of any involvement with the ruling party. This nomination of CJI questions the integrity of the Judiciary. In grave times, it has always been the judiciary which has brought a ray of hope to otherwise dismal political situation. However, with Gogoi pursuing a political career after his Judgeship retirement one can’t help but connect the dots, and doubt the Authenticity of Judgments of the judiciary. 

This also sets like a bad precedent for judges in practice at present that scratching the back of the ruling party would help them after their retirement and hence could cloud their opinions as well as Influence their judgments.
